الملخص
ملخص: تخضع العلاقات الدولية لروابط غير مستقرة، وذلك بالنظر لاختلاف مصالح الدول المتغيرة بين الفينة والأخرى. ورغم تشابك هذه المصالح وما تنتجه من تعقيدات على المستوى الدولي إلا أن ذلك لا يمنع الدول من إبرام المعاهدات الدولية أو الإقليمية متعددة الأطراف. كما انه لا يمنع من جهة أخرى حقها في إبداء التحفظ على ما لا تراه مناسبا لها. وفي هذا الإطار فإن الكثير من معاهدات حقوق الإنسان هي الأخرى لم تخرج عن هذه القاعدة، حيث تكون عرضة للتحفظات من قبل الدول الأطراف على الرغم من أنها تعالج مسائل متصلة مباشرة بالإنسان كونه إنسانا لا غير. و يحدث أحيانا أن تعلل الدول تحفظاتها على مثل هذه المعاهدات بحجة الحفاظ على النظام العام الوطني، وهو الأمر الذي تنظر إليه بعض أجهزة الرقابة التابعة لهذه المعاهدات بعين الريبة، فحسب وجهة نظرها أن ذلك قد يحد كثيرا من ممارسة الحقوق والحريات العامة التي تضمنتها هذه المعاهدات، ورغم ذلك تبقى مسألة حماية النظام العام الوطني أولوية لدى الدول الأطراف المتحفظة لا يمكن إهمالها. Abstract : International relations are subject to unstable ties, given the difference in interests of changing countries from time to time. Despite the complexity of these interests and the complications they produce at the international level, this does not prevent countries from concluding international or regional multilateral treaties. On the other hand, it does not prevent the right of states to express reservations about what they do not see fit for them. Although human rights treaties address issues directly related to the human being, he is a human being. Occasionally, states explain their reservations to such treaties on the pretext of preserving the national public order, This is something that some treaty bodies consider with suspicion, According to her point of view, this could greatly limit the exercise of the public rights and freedoms contained in these treaties, However, the protection of the national public order remains a priority for conservative States Parties, which cannot be neglected.
