"الحد الأدنى للأجر بين منظمتي العمل الدولية والعربية وواقعه في قانون العمل الجزائري" “the Minimum Wage In International And Arab Labour Organizations And Its Impact On The Algerian Labour Law”

الملخص
يعتبر الحد الأدنى للأجر وسيلة لحماية العمال ذوي الدخل الضعيف والضمان لهم ولأسرهم حياة كريمة، مما يحقق الاستقرار السياسي والأمن الاقتصادي والسلم الاجتماعي في مختلف دول العالم. راهنت كل من منظمي العمل الدولية والعربية منذ نشأتهما على إرساء فكرة الحد الأدنى للأجور في علاقات العمل مع استحداث قواعد وأنظمة قانونية تشمل انشاء مجموعة من الإجراءات والمعايير لتحديد قيمته. تبنت الجزائر هذا النظام. إذ اعتمدت في كافة تشريعاتها المتعاقبة التحديد اللائحي للأجر الأدنى المضمون، إلى غاية التسعينات حيث أصبح تحديده يخضع للرأي التشاوري بين ممثلي العمال وأصحاب العمل مع مراعاة المؤشرات الاقتصادية للبلاد، مسايرة للتحولات الاقتصادية والاجتماعية التي فرضتها الازمة الاقتصادية في تلك الفترة. The Minimum Wage is a mechanism to protect low-income workers and guarantee them and their families a decent life; wich is conducive to political stability, economic security and social peace in various countries of the world. That is why, since their establishment, the international and Arab labour organizations have endeavored to assert the idea of establishing the minimum wage in labour relations and have also brought up to set up the rules and legal laws requiring compliance with some procedures and parameters in the minimum wage setting process. Algeria has adopted this regime and it has incorporated, in all its successive legislation, the provision relating to the establishing of the minimum wage until the nineties, the period from which the fixing of the latter was subject to the advice from consultation with workers and employers representatives taking into account the country's economic index.This change was made to bring the legislation into line with the economic and social changes that took place after the economic crisis.
