دور مبدأ ثبات الحدود الدولية ونهائيتها في حفظ السلم والأمن الدوليين

الملخص
تبحث هذه الدراسة في بيان أهمية إقرار مبدأ ثبات الحدود الدولية ونهائيتها كأحد المبادئ الضرورية لاضطلاع الحدود السياسية الدولية بوظائفها والمتمثلة أساسا في استقرار العلاقات بين الدول. وقد كشفت الدراسة أن هذا المبدأ قد كرس دوليا في العديد من المواثيق والاتفاقيات الدولية الى جانب الإعلانات الفردية والجماعية لعديد الدول حتى أضحى قاعدة دولية آمرة تبناها القضاء الدولي في العديد من قراراته المتعلقة بالنزاعات الحدودية. وانتهت الدراسة الى أن احترام مبدأ ثبات الحدود الدولية ونهائيتها يعد من مقتضيات صيانة السلم والأمن الدوليين. This study examines the importance of adopting the principle of the stability of international borders and their finality as one of the principles necessary for the fulfillment of the international political boundaries, which is mainly the stability of relations between states. The study revealed that this principle has been enshrined internationally in many international charters and conventions, as well as individual and collective declarations of many countries, to become a jus cogens base adopted by the international judiciary in many of its decisions concerning border disputes. The study concluded that respect for the principle of the stability and end of international borders is a prerequisite for the maintenance of international peace and security.
