الملخص

الملخص: الوساطة العائلية والاجتماعية إجراء لتسوية حالات النزاع التي قد تنشب في الأسر بين الفروع والأصول المسنين، هدفها الأساسي هو إبقاء المسن في وسطه العائلي بدلا من تركه في دار المسنين أورميه في الشارع، وتكمن أهميتها في تحقيق الاستقرار الأسري والتلاحم العائلي، والمحافظة على الروابط الأسرية بحل خلافاتها بطريقة ودية وسرية، كما تساهم في التقليل من عدد القضايا على مستوى القضاء، ومن ثم التقليل من المصاريف والنفقات. وقد استحدث المشرع الوساطة العائلية والاجتماعية بالمرسوم التنفيذي رقم 16-62 المحدد لكيفيات تنظيمها، مسايرا في ذلك التطور الحاصل في مختلف الأنظمة القضائية في العالم، الرامية إلى استحداث بدائل لحل النزاعات بطرق ودية، ويأتي هذا الترتيب في إطار حماية الأشخاص المسنين والمحافظة على كرامتهم ليعيشوا شيخوخة آمنة، والحقيقة أن الوساطة أسلوب أصيل ومتجذر في ثقافة وتاريخ المجتمع الجزائري، وتستمد قيمها من الشريعة الإسلامية التي تدعو إلى إصلاح ذات البين، والاهتمام بالأصول ورعاية كبار السن. Abstract: Family and social mediation is a procedure for settling conflict situations that may arise in families between the children and the elderly. Its main aim is to keep the elderly in his family instead of leaving him in senior centers or abandoning him on the street. it aims at establishing stability inside the family and preserving family ties by settling conflicts in a friendly and confidential manner. it also contributes in reducing the number of suits in court, and thus reduce the expenses related to them. The legislator has introduced family and social mediation throughout the Executive Decree No. 16-62, which defines how it is organized, in line with the development of the various judicial systems in the world, which aim at developing alternatives to settle conflicts amicably. this arrangement comes to protect the elderly and preserve their dignity. In fact, Mediation is an authentic and deeply rooted method in the culture and history of the Algerian society. Its values are derived from the Islamic law, which calls fo reconciliation and taking care of the elderly.
