الآثار القانونية لعقد احتراف لاعب كرّة القدم- دراسة مقارنة

الملخص
انتشرت ظاهرة الاحتراف الرياضي في العصر الحديث بشكل كبير، وتغلغلت في أنظمة وقوانين أغلب دول العالم، وأصبحت الشغل الشاغل لشريحة لا يستهان بها من بني البشر، وخاصة في كرة القدم باعتبارها الرياضة رقم واحد في العالم. وانطلاقاً من كون عقد احتراف لاعب كرة القدم كسائر العقود يخضع للنظرية العامة للعقد خصوصاً في المبادئ العامة المتعلقة بشروط تكوينه لكن مع احتفاظه ببعض المميزات عند إبرامه نصت عليها لوائح الاحتراف، وما يتسم به من خصوصيات مخالفة للقواعد العامة، ومن جانب أخر فإن عقد عمل اللاعب المحترف هو عقد ملزم للجانبين، مما ينتج عنه حتما آثار قانونية تتمثل في التزامات ينشؤها هذا العقد على عاتق كل من الطرفين.
