عن دور مجلس الأمن في حماية وترقية حقوق الإنسان

الملخص
الملخص: لقد شكل تحقيق احترام حقوق الإنسان أساسا لتبلور نظام قانوني دولي يعرف بالقانون الدولي لحقوق الإنسان، تطلب ذلك مرحلتين أساسيتين؛ تتمثل المرحلة الأولى في مرحلة بناء قواعد القانون الدولي لحقوق الإنسان عبر قيام الفقه والمنظمات غير الحكومية الدولية بنشر الوعي بأهمية مسألة حقوق الإنسان ما يؤثر بالضرورة في الموقف الرسمي للدول والذي انتهي بصوغ نصوص اتفاقية دولية حددت مضمون حقوق الإنسان. تتمثل المرحلة الثانية في مرحلة إعمال وتفعيل تلك القواعد وذلك عبر المساهمة الفاعلة لأجهزة الأمم المتحدة لذلك يجب على مجلس الأمن أن يلعب دورا فعالا في منع اندلاع النزاعات المسلحة خاصة غير الدولية منها والمساهمة في بلورة حلول سياسية لها عبر اعتماد الإجراءات التالية؛ العقوبات الذكية، المتابعة الجنائية وقوات السلام، سينعكس ذلك إيجابا على تحقيق احترام وترقية حقوق الإنسان. Résumé : La réalisation du respect des droits de l'homme a été la pierre angulaire du développement d'un ordre juridique international appelé droit international des droits de l'homme, qui requiert deux phases fondamentales. La première étape consiste à l’édification des règles du droit international des droits de l’homme grâce à une prise de conscience accrue de l’importance de la question par la doctrine et les organisations non gouvernementales, ce qui a influé nécessairement sur la position officielle des États en donnant lieu à l’élaboration d’une convention internationale définissant le contenu des droits de l’homme. La deuxième étape est la phase de mise en œuvre et d’accroissement de ces règles du fait de la contribution effective des organes de l’ONU. D’où, le Conseil de sécurité doit jouer un rôle efficient pour éluder le déclenchement de conflits armés, en particulier des conflits non internationaux, et contribuer à la mise en œuvre de solutions politiques en épousant les mesures suivantes; sanctions intelligentes, suivi pénal et forces de paix, cela aura une incidence positive sur le respect et la promotion des droits de l'homme. Abstract: The realization of respect for human rights has been the cornerstone of the development of an international legal order called international human rights law, which requires two fundamental phases. The first step is the construction of the rules of international human rights law through increased awareness of the importance of the issue by the doctrine and non-governmental organizations, which necessarily influenced the position States by giving rise to the drafting of an international convention defining the content of human rights. The second stage is the phase of implementation and increase of these rules because of the effective contribution of the organs of the United Nations. Hence, the Security Council must play an effective role in avoiding the outbreak of armed conflict, particularly non-international conflicts, and contribute to the implementation of political solutions by adopting the following measures; smart sanctions, penal follow-up and peace forces, this will have a positive impact on the respect and promotion of human rights.
