الأحكام الفقهية والقانونية لبيع الأعضاء البشرية دراسة مقارنة بين الفقه الاسلامي والتشريع الجزائري

الملخص
يعد بيع الأعضاء البشرية من المسائل المستحدثة والذي دعت إليه الحاجة والفاقة، وإمكان تربح الناس من أعضاء جسده، والتي لا يضر انتزاعها بحياة الإنسان، بحيث يمكن مع عدم وجودها استكرار قيامه بالأنشطة الحيوية لجسده، وقد دفع إلى ذلك المبالغ الطائلة التي ستعد لدفعها الأغنياء من أجل استرجاع عافيتهم سواء للمستشفيات والأطباء والسماسرة الذي يتوسطون لذلك، حيث ظهر نشاط مربح فيما يسمى بالسياحة الطبية، أين يلتقي البائع والمشتري للعضو ويتم التبادل بكل سلاسة وسهولة، وهو الأمر الذي تفطنت له الجماعات الإجرامية وجعلته مصدرا مهما لنشاطاتها بما أنه أأمن من تجاة المخدرات والسلاح وغيرها، ولذلك كان لزاما على المجتمعات التعاطي مع هذا المستجد ومحاولة قمعه خصوصا بوضع أحكام وتشريعات تحد من انتشار هذه الظاهرة التي تمتهن كرامة الكيان البشري ومنها المشرع الجزائري، والشريعة بكونها سباقة في المجالات المستجدة فقد انبرى فقهائها لتوضيح الأحكام المناسبة لهذه النوازل التي تطرأ على حياة البشر. الملخص بالإنكليزية: The sale of human organs is one of the new issues that has been called for by the need and need, and the possibility of gaining people from the body parts, whose extraction does not harm human life, so that without its presence, it is possible to repeat the vital activities of his body, and he has paid the huge sums that will be prepared for the rich to pay.
