Les Cyber-attaques Face Au Jus Ad Bellum Etude Et Commentaires Sur Le Manuel De Tallinn

Abstract: States and individuals increasingly use cyber technology for peaceful purposes, but they are also employed maliciously. Cyber-attacks that is, the use of cyber technology to attack a state’s infrastructure are perhaps one of the most serious threats currently facing states. Although not all cyber-attacks are warlike, some of them may indeed be so, which immediately gives rise to the question of whether the current legal regulation of the use of force jus ad bellum applies to such attacks. The ‘Tallinn Manual’ on the International Law Applicable to Cyber Warfare responds to this question by mapping out the jus ad bellum and jus in Bello rules that apply in such circumstances. The statement of the Rules is accompanied by a Commentary, which clarifies the content of those rules and explains their application in the specific context of cyber warfare. In the following, this study will present and comment critically on the jus ad bellum rules of Chapter 2 of the Tallinn Manual (2013) and Chapter 14 of the second edition of the Manual (2016). The purpose of this commentary is to draw attention to some important but contentious issues, to identify jurisprudential ambiguities and, if possible, to offer different points of view. يطّردُ الإستخدام السلمي من قبل الدول والأفراد للتكنولوجيا السيبرانية، في حين يبقى توظيفها لأغراض عدائية امر وارد. ولربما تكون الهجمات السيبرانية، أي استخدام تلك التكنولوجيا للهجوم على البنية التحتية الحرجة للدول، واحدة من أخطر التهديدات التي تواجه الدول حاليًا. على الرغم من أن تلك الهجمات لا تصل في معضمها الى ذروة الحرب، بيد أن بعضها قد يكون كذلك، الأمر الذي يثير مسألة ما إذا كان التنظيم القانوني الحالي لسير النزاعات المُسلّحة في القانون الدولي يُطبّق على مثل تلك الهجمات. بالموازة مع ذلك يستجيب "دليل تالين" الخاص بالقانون الدولي المطبق على الحرب السيبرانية على هذا السؤال من خلال رسم خارطة قوانين اللجوء إلى الحرب وقانون الحرب. مُرفقًا ببيان القواعد وتعليقات توضح محتوى تلك القواعد وشرحها بتطبيقات في السياق المحدد للحرب السيبرانية. فيما يلي، فإن هذه الدراسة تقدم وصفًا وتعليقًا بشكل تحليلي على قواعد اللجوء إلى الحرب من خلال الفصل 2 من دليل تالين لسنة (2013) والفصل 14 من طبعته الثانية لسنة (2016). والغرض من هذا التعليق هو لفت الانتباه إلى بعض القضايا الهامة والمثيرة للجدل، لتحديد الغموض الفقهي، وتقديم وجهات نظر مغايرة.
