الملخص
الماء والهواء عنصران أساسيان لقيام الحياة على الأرض، ولا يمكن للإنسان الاستغناء عنهما، ولكن التطور الصناعي، والنمو الديمغرافي، والاستغلال الغير العقلاني لموارد الأرض،وحاجة الإنسان إلى الطاقة لتلبية حاجاته ،أدي إلى تلوث الماء والهواء، مما جعل الإنسان يبحث عن سبل لحمايتهما ،فاصدر قوانين وتشريعات تتماشى مع متطلباته للطاقة ،كما أن الشريعة الإسلامية اهتمت هي الأخرى بالماء والهواء، على اعتبار أن من مقاصد الشريعة الإسلامية حفظ النفس، ولا يتأتى ذلك إلا بالحفاظ على الماء والهواء ،مع العلم إن فقهاء الشريعة الإسلامية وضعوا قواعد فقهية استنبطوها باستقراء النصوص الشرعية (القران الكريم والسنة النبوية) منها الضرر يجب أن يزال، درا المفاسد أولى من جلب مصالح ،ارتكاب أخف الضررين وأهون الشرين، كل ذلك للتوفيق بين متطلبات الإنسان العصرية وحماية الماء والهواء، باعتبارهما من الضروريات. Abstract: Water and air are two main items for life on Earth, and human cannot get ridof them. However the industrial development, demographic growth, bad use of land resources and the energy to meet his/her needs give rise to water and air pollution; these make human search for ways to protect them, and issued laws and regulations go with his needs for energy. Islamic Shariaa was also concerned with water and air on the basis that self-safety is one of Islamic Shariaa’s purposes and this cannot be reached except by protecting water and air knowing that scholars of Islamic Shariaa have set rules of jurisprudence which were educed by induction of legal texts ( Quoran and Sunnah ) ;so harm have to be removed , abuse is prior from interests, commiting the lesser evil, all this to reconcile between modern needs of human and protection of water and air since they are one of human necessities.
