دور المجالات المحمية في حماية البيئة (the Role Of Protected Areas In The Conservation Of Nature)

الملخص

تهدف هذه الورقة إلى البحث في مدى فعالية النظام الخاص بالمجالات المحمية الذي أقره المشرع الجزائري في إطار القانون رقم 03-10 المتعلق بحماية البيئة في إطار التنمية المستدامة، ومن أجل تفعيل هذا النظام أكثر، خصه المشرع بقانون خاص وهو القانون رقم 11-02 المتعلق بالمجالات المحمية في إطار التنمية المستدامة، وذلك عن طريق تعريف المجالات المحمية وبيان الإطار القانوني والتنظيمي الذي تخضع إليه، وكذا تصنيفها وتحديد كيفيات تسييرها وحمايتها في إطار التنمية المستدامة. تقتضي حماية المجالات المحمية في المقام الأول تصنيفها، وما يترتب عن ذلك آثارا هامة تساهم في استدامة الأنظمة البيئية، كما يتطرق البحث إلى كيفيات تسيير المجالات المحمية، سواء بدراسة الهيئات المخول لها تسييرها أو دراسة المخططات التوجيهية لها ومخططات تسييرها، تم التطرق في الأخير لمعوقات التسيير المستدام لهذه المجالات حفاظا على الطبيعة. The purpose of this paper is to examine the effectiveness of the system of protected areas approved by the Algerian legislator under Law No. 03-10 on the protection of the environment in the context of sustainable development. In order to activate this system more, the legislator has issued a special law, Law No. 11-02, In the context of sustainable development, by defining protected areas, indicating the legal and regulatory framework to which they are subject, as well as their classification and identification of their management and protection in context of sustainable development. The protection of protected areas requires, first and foremost, classification, with significant implications for the sustainability of ecosystems. The study also discusses the management of protected areas, whether they study the bodies authorized to conduct them or study their guidelines and plans.
