التعويض عن المنتوجات المعيبة كحماية لحقوق المستهلكين

الملخص
يعتبر موضوع حماية المستهلك من المواضيع التي أولاها المشرع الجزائري أهمية خاصة نظرا لاحتمال المساس بصحة و سلامة المستهلك ،جراء الأضرار التي قد تلحق به لعدم التزام بعض المنتجين بشروط السلامة اللازمة و معايير الانتاج السليمة بسبب السعي وراء تحقيق الربح السريع و تبوئ أعلى المراتب على الصعيد الاقتصادي ،و ما يزيد الاشكال تعقيدا هو اختلاف المراكز،إذ يعتبر المنتج بمكان قوة مقارنة بالمستهلك الضعيف الذي يجد نفسه مجبرا على اقتناء هذه المنتوجات لسد حاجاته الطبيعية.هذا ما جعل المشرع يتدخل محاولا توفير الحماية القانونية اللازمة للمستهلك، و هذا من خلال تكريس نظام قانوني خاص بعيدا عن القواعد العامة في القانون المدني و التي أصبحت غير كافية لضمان حماية المستهلك من أضرار و مخاطر المنتجات بإقرار مسؤولية المنتج و إلزامية التعويض عن الضرر الحاصل تبعا لاستهلاك منتوجاته المعيبة. Abstract The issue of consumer protection is one of the topics that the Algerian legislator has given special importance due to the potential for prejudice to the health and safety of the consumer and dint of the damages that may be caused to him because of the failure of some producers to comply with the necessary safety conditions and sound production standards.Because of the pursuit of rapid profit and the assumption of the highest ranks on the economic level, and what is complicated by the more complex shapes is the difference in centers, as the product is a strong place compared to the weak consumer who finds himself forced to purchase these products to meet his natural needs. This is what made the legislator intervene in an attempt to provide the necessary legal protection to the consumer, and this is by devoting a special legal system away from the general rules in the civil law, which have become insufficient to ensure the protection of the consumer from product damage and risks by acknowledging the responsibility of the product and the obligation to compensate for the damage incurred accordingly To consume its defective products.
