الطبيعة القانونية للدفتر العقاري وحجيته في اثبات الملكية العقارية الخاصة

الملخص
يعد موضوع إثبات الملكية العقارية الخاصة من أهم المواضيع التي لم تحظى بالدراسة الكافية خاصة مع تعدد الوسائل القانونية لإثبات الملكية كالسندات التوثيقية و الإدارية إلى جانب السندات القضائية ،و مع إتباع المشرع الجزائري لنظام الشهر العيني الذي يقوم على أساس مسح الأراضي فقد جعل الدفتر العقاري السند الوحيد لإثبات الملكية العقارية ،و لهذا يتلخص موضوع هذا المقال في أنه يحاول تحديد الطبيعة القانونية للدفتر العقاري و يبين حجيته في إثبات الملكية . Le sujet de preuve de la propriété foncière privée constitue l’un des sujets qui n’a pas eu sa part suffisante par les études notamment avec la diversité des moyens juridiques de prouver la propriété tels que les titres notariés et administratifs en plus des titres légaux. Par son adoption de la méthode de publicité individuelle se fondant sur le cadastre, le législateur Algérien a rendu le livret foncier comme titre unique pour prouver la propriété foncière. C’est pour cela que le sujet du présent article se résume dans une tentative de déterminer la nature juridique du livret foncier et démontrer son opposabilité à prouver la propriété . The subject of proof of private land ownership is one of the subjects which has not had its sufficient through studies including the diversity of legal means to prove ownership such as notaries and administrative titles in addition to legal titles. By its adoption of the method of the Algerian legislator a, individual publicity based on the cadastre rendered the land register as a single title to prove land ownership. For this reason the subject of this article is summarized in an attempt to determine the legal nature of the land register and demonstrate its opposability in proving the ownership.
