الملخص
ملخص يتمتع رئيس الجمهورية في كل من النظامين الجزائري والفرنسي بصلاحيات و اختصاصات واسعة، تدفعه أحيانا إلى ارتكاب جرائم معينة، واستنادا للمبدأ القائل أينما توجد السلطة توجد المسؤولية، فلا سلطة بدون مسؤولية ولا مسؤولية بدون سلطة، وهذا ما يجعله يخضع إلى المسؤولية السياسية والجنائية في حالة إخلاله بواجباته الدستورية. ويهدف هذا البحث إلى دراسة الخيانة العظمى، باعتبارها الحالة الاستثنائية لإنهاء العهدة الرئاسية لرئيس الجمهورية، بسبب إخلاله بمهامه الدستورية، بحيث يصبح فيها معرضا للمتابعة القضائية التي تؤدي لعزله من منصبه، إذا ما ثبت للسلطة المختصة بعد التحقيق أنه متورط في اقتراف جريمة الخيانة العظمى، وذلك وفقا لقواعد وإجراءات قننها المؤسس الدستوري الفرنسي. Abstract The President of the Republic, both under the Algerian and French regimes, has extensive powers, which sometimes leads to the commission of certain crimes. On the basis of the principle that , where authority exists, responsibility also exists, there is no authority without liability or responsibility without authority, which makes it subject to political and criminal responsibility in the event of breach of his constitutional duties. The purpose of this research is to examine the high treason, as an exceptional case of termination of the presidential term of office of the President of the Republic, because of the violation of dismissal from his post. If it results from the competent authority, after investigation, that it is involved in the commission of the crime of high treason, in accordance with the legal rules and procedures established by the french constitutional legislator.
