الحماية الجنائية للعلاقة الزوجية بين التشريع الجزائري و التشريع المصري جريمة الخيانة الزوجية أنموذجا

الملخص
تهتم هذه الدراسة بجريمة الخيانة الزوجية التي تعتبر من الجرائم الخطيرة المؤثرة سلبا سلبا على العلاقة الزوجية، وذلك لما قد يترتب عن هذه الجريمة من إهانة للزوج الضحية والمساس بعرضه وشرفه، مما يؤدي إلى تفكك الرابطة الزوجية لاسيما أن الزوج المتضرر غالبا ما يلجأ إلى القضاء من أجل رفع دعوى الطلاق على الزوج الزاني، ولهذا كان على التشريع الجزائري التصدي لهذه الجريمة بكل قوة وحزم من أجل حماية العلاقة الزوجية. ولقد أحاط كل من القانون الجزائري والقانون المصري العلاقة الزوجية بحماية قانونية وذلك من خلال تجريم الخيانة الزوجية، حيث فرض كل من القانونين على مرتكب فعل الخيانة الزوجية سواء كان الزوج أو الزوجة عقوبة من أجل الحد من هذه الجريمة، غير أن كل من المشرعين لم يصلا إلى تحقيق المراد من تجريم الخيانة الزوجية وذلك نتيجة لعدم معالجة هذه الجريمة بالطريقة المناسبة وعدم فرض العقوبة الكافية. The crime of infidelity is considered a serious crime affecting the marital relationship. This may result in an insult to the husband victim And Infringement to his offer and honor, which leads to the disintegration of the marital relationship, especially that the damge husband is often resort to the judiciary in order to file a divorce lawsuit on the adulterous husband, Therefore, Algerian legislation had to deal with this crime with all force and firmness in order to protect the marital relationship. Algerian law and Egyptian law have taken into account the legal protaction of the marital relationship through the criminalization of infidelity. Both laws impose on the perpetrator of adultery whether the husband or wife has a penalty in order to limit the crime. However, both legislators have not reached To achieve the purpose of criminalizing adultery as a result of failure to address this crime in the appropriate manner and not to impose sufficient punishment.
