الملخص
من خلال هذه الورقة البحثية، سنحاول عرض الأبعاد المكونة للنظام العمومي، وكيف لم تستقر على تلك الأهداف الكلاسيكية التي بنيت عليها، وخرجت من طابع الاستثناء المقيد للحرية الفردية من خلال منع الفوضى والاضطراب، وأصبحت نظاما متحركا يشمل جميع الميادين والمجالات، وبذلك خرج النظام العمومي من الحيز الكلاسيكي، الذي كان قاصرا على النظرة السلبية، إلى نظام يقوم على فكرة محورية تتضمن أهداف الجماعة، شأنها في ذلك شأن المرفق العمومي، ذو المسعى الإيجابي البحت، كحماية الجانب المعنوي، البيئة ومراعة النقاوة والجانب الصحي والجمالي لها. This article deals with one of the most important topics of the adminitrative law, which is the public order and its dimensions, as well as them evolution. We have tried to analyze the various components of this concept, in order to provide evidence that it didn’t stick on its classical dimenssions, and explaining how its ambit had broadened substantially, from the restricted nature of individual freedom, and fighting against the disorder, to an unsteady system encompassing all domains, based on a central idea including with purely positive objectives, such as the moral public order, protecting especially in the environment, as well as its healthy and aesthetic side.
