المرأة اللاجئة الواقع والرهانات: اللاجئة السورية نموذجا

الملخص
إن وضعية المرأة اللاجئة تعتبر الأكثر تأثرا في أوقات النزاعات المسلحة، حيث عانت على مر العصور من التهجير نتيجة الحروب وما ترتب عليها من فقدانها للمسكن والأقارب وتعرضها للاستغلال، إذ تشكل النساء الغالبية العظمى من ملايين اللاجئين في العالم؛ ما يطرح إشكالية آليات ومؤسسات الحماية الدولية للاجئات ومدى توافقها مع الواقع الحالي لمشكلة اللجوء. إن ضمان حماية ومساعدة أفضل للنساء المتأثرات من النزاعات المسلحة يتطلب فهم القانون الذي يوفر لهن الحماية؛ فالقانون الدولي وخاصة القانون الدولي الإنساني وقانون اللاجئين والقانون الدولي لحقوق الإنسان، تعالج احتياجات النساء في النزاعات على نحو ملائم. ويجب فهم بوضوح أن اتفاقيات جنيف والبروتوكولين الإضافيين ومختلف صكوك حقوق الإنسان تنص على واجب قانوني هو حماية السلامة البدنية والنفسية للنساء وكرامتهن. The status of refugee women is most affected in times of armed conflict, Where it suffered through the ages of displacement as a result of wars and the consequent loss of housing and relatives and exposure to exploitation, Women constitute the vast majority of the millions of refugees in the world; this raises the problem of mechanisms and institutions for the international protection of refugee women and their compatibility with the current reality of the refugee problem. Ensuring better protection and assistance to women affected by armed conflict requires understanding of the law that protects them; international law, particularly international humanitarian law, refugee law and international human rights law, Adequately address the needs of women in conflict. It must be clearly understood that the Geneva Conventions, the Additional Protocols and the various human rights instruments provide for a legal duty to protect the physical and psychological integrity and dignity of women.
