الملخص
الملخص : لقد جاء البحث الموسوم بـ(الصلاحيات الدستورية للسلطات العامة الاتحادية واثرها في الحد من الفساد الاداري- العراق انموذجا)لدراسة مشكلة من اعقد المشاكل التي تسببت في انهيار الكثير من الانظمة الى جانب عوامل اخرى ، والسعي للبحث والاستقصاء في النصوص التشريعية والجوانب العملية للسلطات الثلاث للوقوف على الدور الذي تمارسه في ميدان مكافحة الفساد وتقييمه ، وقد توصل الباحث من خلال هذه الدراسة الى العديد من الاستنتاجات ولعل اهمها وجود العديد من الثغرات والعيوب التي شابت النصوص التشريعية التي نظمت عمل تلك السلطات، والتي من شأنها ان تضعف دورها في مكافحة الفساد، فضلاً عن عدم وجود قوانين متخصصة في مكافحة الفساد وتأخر مجلس النواب في اقرار مشروع قانون مكافحة الفساد رغم مرور مايقارب اكثر من احد عشر عاماً على مصادقة مجلس النواب العراقي على اتفاقية الامم المتحدة لمكافحة الفساد لعام 2003 بموجب القانون رقم 35 لعام 2007 . Abstract: Our research, entitled "The Constitutional Powers of the Federal Public Authorities and their Effect in Reducing Administrative Corruption," is a study of one of the most complex problems that caused the collapse of many systems, among other factors. It also seek to search and investigate the legislative texts and practical aspects of the three authorities, In the field of combating and evaluating corruption, We have reached through this study many conclusions and perhaps the most important is the existence of many gaps and flaws in the legislative texts that organized the work of those authorities, which would weaken their role in the fight against corruption, as well as the lack of specialized laws in the fight against corruption and the delay of the House of Representatives in Adoption of the anti-corruption bill Despite the passage of more than 11 years passed the approval of the Iraqi Council of Representatives on the United Nations Convention against Corruption for 2003 under Law No. 35 of 2007.
