التوثيق وأثره في إثبات الحقوق بين الزوجين.

الملخص
الملخص. لقد شرع الله تعالى الشهادة على عقد الزواج حفاظا على الحقوق التي يرتّبها العقد، من نسب ونفقة وسكنى وغيرها، كما أن الشهادة تنفي التهمة والريبة في اللقاء بين الزوجين، وتخرج الزواج من السر إلى العلن، لكن في ظل فساد الذمم وانتشار الكذب والجحود في إقامة العلاقات الزوجية، أوجب المشرع الجزائري عملية توثيق الزواج في الدوائر الرسمية المخصصة لذلك، وهذا مبدأ لا يتنافى مع الشريعة الإسلامية، بل هو من جملة مقاصدها وأهدافها السامية في الحفاظ على عقد الزواج من التلاعب، وحفظ حقوق الأولاد من الضياع. لقد جاء هذا البحث لبيان أهمية التوثيق في حماية حقوق الزوجين، وبيان مسؤولية ضابط الحالة المدنية في مراقبة أركان عقد الزواج وشروطه، وكذا تسجيله في السجلات الخاصة بذلك. الكلمات الدالة. التوثيق؛ الشهادة؛ الموثق، النظام العام، الزواج، النكاح، الحالة المدنية، الشروط الجعلية، مقتضى العقد، الشهود، Abstract God has decreed the witness for marriage contract in order to preserve the rights, as a relationship, pension and housing, and others, and the certificate denies the charge and mistrust in the meeting between the spouses, and graduated from marriage to the secret to the public, but in light of the corruption and the spread of lies and arrogance in establishing relations The Algerian law requires the process of documenting marriage in the official circles allocated to it. This principle is not incompatible with Islamic law, but it is among its purposes and lofty goals in maintaining the marriage contract of manipulation and preserving the rights of children from loss. This research is intended to demonstrate the importance of documentation in protecting the rights of the spouses and to indicate the responsibility of the civil status officer in monitoring the elements and conditions of the marriage contract as well as its registration in the relevant registers.
