الملخص
الملخص: خوّل المشرع السلطات الإدارية المستقلة اختصاصات هامة لضبط المجال الاقتصادي والمالي، وإذا كان المشرع قد أقر وبموجب نصوص خاصة استقلالية هذه السلطات، إلا أنه أخضعها لرقابة القضاء باعتباره كضمانة هامة للأشخاص الذين تخاطبهم.غير أن الرقابة القضائية لا تعتبر الضمانة الفعالة ضد تعسف هذه السلطات، ذلك أن النتيجة التي تحققها قد لا تسمح بدرء الضرر اللاحق. لذا لابد من وضع ضمانات تكفل ذلك، وتسمح بخلق التوازن بين السلطة القمعية الممنوحة لها وحقوق المتعاملين معها. يعد مبدأ وقف تنفيذ القرارات الصادرة عن هذه السلطات الإدارية المستقلة إحدى هذه الضمانات وذلك بالنظر إلى النتائج التي يحققها. لذا تطرح للدراسة مدى إخضاع هذه القرارات لهذا المبدأ لاسيما في النصوص المنشئة لها مقارنة بالأحكام المقررة في القواعد العامة. الملخص باللغة الانجليزية The legislator authorized the independent administrative authorities to have important powers to control the economic and financial sphere. If the legislator had approved the independence of these authorities under special texts, they were subject to judicial supervision as an important guarantee for the persons who addressed them. However, judicial supervision is not an effective guarantee against the arbitrariness of these authorities. That the result achieved may not allow for the prevention of subsequent damage. Therefore, it is necessary to establish guarantees to ensure that, and allow the creation of a balance between the repressive authority granted to it and the rights of its clients. The principle of suspension of decisions issued by these independent administrative authorities is one of these guarantees in view of the results achieved. Therefore, it is proposed to study the extent to which these decisions are subject to this principle, especially in the texts establishing them, compared to the provisions
