الطبيعة القانونية في عقد البوتb.o.t في مجالات البناء و التشغيل و نقل الملكية

الملخص
من اهم العقود التي باتت متداولة لدى معظم الدول النامية بهدف انشاء البنى التحتية، هي العقود التي تهدف الى الانشاء والتشغيل واعادة الملكية للمرفق العام، ولأن هذا النوع من العقود هو من عقود الانشاءات الدولية كما بينا ذلك في البحث، استدعى منا التركيز حول مدى اعتباره اداري او مدني او هو ذو طبيعة مختلفة، وبعد عرض اهم تعاريف لعقود البوت وانواعه المتشعبة والمتفرقة بينه وبين ما يشبهه من عقود، خلصنا الى ان هذا العقد هو من العقود الخاصة ذات الطبيعة غير المألوفة التي توفق بين الادارة من جهة عن طريق الشروط اللائحية وبين المستثمر الاجنبي عن طريق الشروط التعاقدية وبذلك فهو عقد تحت سلطة الادارة من جهة وبين ارادة المتعاقدين من جهة اخرى. ويبقى مجال البحث في هذا النوع من العقود مفتوح.
