فعالية بديل العقوبة في إستثمار وجدان الهاكرز

الملخص
الملخص: ما الجريمة المعلوماتية إلا إنعكاس لوجدان مرتكبها وواقع مجتمعها، والهاكر كواحد من أولئك "المجَرَّمين"، هو مُبرمِج مهووس بالحاسب الآلي وأنظمته، يمتلك قوى باطنية خلاّقة، يميل إلى الحرية، يرفض الاحتكار، يسعى إلى إثبات وجوده وفرض ذاته. إذ لا يجد غير البيئة الرقمية الافتراضية متنفسا يمنحه مسرح لامتناهي الحدود للانطلاق نحو الحرية والتحدي. ورغم أنه قلما يتوفر الباعث الإجرامي في تصرفاته، إلا أنها قد تؤدي إلى المساس بالغير، فيكون هذا المساس محلا للتجريم بغض النظر عن الباعث. ووفقا لمبدأ الشرعية الجزائية، فإن لكل سلوك إجرامي عقابا؛ إما يمس بالحرية أو بالذمة المالية لشخص الجاني. غير أنه في حالة جرائم التهكير فإن كلا صنفي العقاب سيجلبان لنا مزيدا من الخسائر. في هذا المقال نقترح تطبيق بدائل العقوبة على الهاكر بصفته ثروة قومية نادرة من واجبنا تعهُّدها بالعناية والتوجيه لخدمة البلاد بدل كبحها وتحنيطها. الكلمات المفتاحية: وجدان الهاكر، جريمة التهكير، الباعث الإجرامي، بديل العقوبة. The effectiveness of alternative punishment in the investment of the hackers' soul Abstract: Cybercrime is considered as a reflection to the criminal’ s feeling and the current society, and the hacker is one of these criminals who proceeds with programming cybercrimes which cause the breaking down of computers’ systems. Accordingly, he possesses creative underground forces, tends to be free, rejects monopoly, seeks to prove his existence, and impose himself. He relies only on the digital virtual environment which provides him with an outlet and gives him an infinite space of freedom and challenge. Although the criminal motive is rarely available in the hacker's actions, it may lead to harm others, so that this violation is subject to criminalization regardless of the motive. According to the principle of legality in the Criminal Law, any criminal conduct is punishable; whether it affects his liberty status, or financial liability of the offender. However, in the case of hacker’s crimes, the two types of punishments will result in further losses. In this paper, we propose to implement other alternatives of punishment to the hacker, since it is considered as a rare national wealth. Therefore, it is our duty to take care of with true guidance to serve the country rather than to curb it. Key words: Hacker’s feeling, hacker’s crime, criminal motive, alternative punishment.
