الملخص
الملخص: تعتبر سلطة الإدارة في إنهاء العقد الإداري لدواعي المصلحة العامة، من أبرز الخصائص التي يمتاز بها العقد الإداري عن غيره من العقود، وإحدى أخطر السلطات التي تتمتع بها جهة الإدارة في مواجهة المتعاقد معها، لما يترتب عنها من وضع حد نهائي وفاصل في تنفيذ العقد الإداري، والتي تستطيع الإدارة مباشرتها بنفسها ودون حاجة منها إلى اللجوء للقضاء، بل وحتى في غياب النص عليها. وأساس ذلك كله ومرده هو فكرة تأمين سير المرافق العامة بانتظام وإضطراد، وتحقيق الصالح العام، في ظل عقود أصبح تنفيذها غير ذي فائدة. Résumé : Le pouvoir exorbitant de l’administration de mettre fin à des contrats administratifs pour une raison d’intérêt général est considéré parmi les caractéristiques les plus importantes qui différencie le contrat administratif des autres contrats. Il est, en même temps, l’un des pouvoirs les plus dangereux dont bénéficie principalement l’autorité administratif face au contractant du fait de pouvoir mettre définitivement un terme à l’exécution du contrat administratif sans la nécessité de s’adresser à la justice, mieux encore, même en l’absence d’un texte. Le fondement de ce pouvoir se justifie par la nécessité accrue du bon fonctionnement des services publics, voire l’interêt general dans un contexte que certains contrats sont devenus inutiles de par leur execution. Abstract : The administrative power when puting and end to an administrative act for puplic interests is regarded to be a distinctive feature of that act towords other acts, Besides ,that power is itself a dangerouse aspect any administration may have to confront the one engaged with it ,This last idea is linked to the process of finishing the aproval of any administrative act, The mentioned procedure can be done with no refrence to the judiciary power and even in case of text’s absence ,The rational behind is associated with to idea of ensuring the fleunecy and organization of public spheres in the light of some acts whose their application is needless.
