أهمية التعاقد عبر البوابة الإلكترونية للصفقات العمومية

الملخص
الملخـــص: لقد سعى المشرع الجزائري من خلال التعديلات المتتالية لقانون الصفقات العمومية، وآخرها المرسوم الرئاسي رقم 15-247، المتضمن الصفقات العمومية وتفويضات المرفق العام، إلى مواكبة التطورات والمستجدات التي فرضتها ظاهرة العولمة والتطور التكنولوجي تمخضت عنها طرقا جديدة في إبرام العقود بصفة عامة والعقود الإدارية بصفة خاصة، تمثلت في استخدام طرق التكنولوجيا الحديثة في إبرام الصفقات العمومية والتي أظهرت مصطلحا جديدا تبنته بعض التشريعات وهو مصطلح "تجريد الصفقات العمومية من صبغتها المادية" وذلك بإدخال وسائط إلكترونية في إبرامها بين المصالح المتعاقدة والمتعاملين الإقتصاديين عبر البوابة الإلكترونية للصفقات العمومية. هذا ما نص عليه المرسوم الرئاسي المذكور أعلاه من خلال مادتين فقط. وتطبيقا لهما صدر القرار المؤرخ في 17 نوفمبر 2013 الذي يحدد محتوى البوابة وكيفية تسييرها وتبادل المعلومات عبرها. Résumé : Le législateur algérien, par des amendements successifs du droit des marchés publics jusqu’au décret présidentiel n°15-247, s’est montré actif en embrassant les développements tant technologiques que numériques et les évolutions imposés par le phénomène de la mondialisation. D’où, l’apport de nouvelles façons de conclure des contrats d’ordre administratif et ce, en particulier, l'utilisation des moyens modernes quant à la passation des marchés publics. Ceci est à l’origine de la naissance d’une nouvelle procédure dite "dématérialisation des marchés publics", que certaines législations ont embrassée donnant lieu à l'introduction d’intermédiaires d’ordre électronique dans la passation desdits marchés tout en tenant compte des intérêts des différents intervenants. Cette démarche résulte explicitement du décret présidentiel mentionné ci-dessus à travers deux articles seulement. Néanmoins, les modalités d`application de ces deux articles ont été auparavant fixées par arrêté du 17 Novembre 2013, lequel définit à travers le portail son contenu ses modes de conduite et l'échange d'informations. Abstract: The Algerian legislator has sought through amendments to the public marches of law to Presidential Decree N° 15-247, on the regulation of public markets and delegation of public services, to keep abreast of developments and changes imposed by the phenomenon of globalization and technological development, provided new ways to conclude contracts in general and administrative contracts, in particular, was the use of modern technology means the conclusion of public contracts.
