حرية الزوجة في التصرف في مالها -بين نقائص التشريع والواقع الأسري المعاش-

الملخص
ملخص: يعتبر النظام المالي للزوجين أحد أبرز الجوانب المادية للزواج، أين كانت الشريعة الإسلامية أوّل من أقرّت بمبدأ استقلالية الذمم المالية للزوجين، وعلى نفس المنهج سار المشرع الجزائري بموجب الفقرة الأولى من المادة 37 من قانون الأسرة. ولمسايرة التطوّرات الاجتماعية والاقتصادية الراهنة اعترف أيضا بنظام الاشتراك في الأموال بمقتضى الفقرة الثانية من المادة 37 من نفس القانون، إلاّ أنّ هذا التدخل جاء محتشما فلم تخل هذه الفقرة من عدّة ثغرات تشريعية. Résumé : La Shari’a a été la première à reconnaître le principe de l’autonomie des avoirs financiers des époux, régime considéré comme l’un des principaux aspects financiers du mariage, que le législateur algérien s’en est inspiré de cette loi, par l’alinéa 1 de l’article 37 du code de la famille. Mais, afin de se conformer aux changements socio-économiques, le législateur a adopté en 2005 le régime de la communauté des biens acquis après mariage et ce, en vertu de l’alinéa 2 de l’article 37 in fine. Or, cet amendement s’est avéré insuffisant sur le plan de la pratique. Abstract: The Shari ‘a was the first to recognize the principle of the autonomy of the financial assets of the couple, considered as one of the main financial aspects of marriage, that the Algerian legislator drew inspiration from it of this law, by the paragraph 1 of Article 37 of the Family Code. However, in order to comply with socio-economic changes, in 2005 the legislator adopted the community property regime acquired after marriage, by virtue of the paragraph 2 of the article 37 in fine. This amendment proved to be insufficient in terms of practice.
