منتقى من نصوص الإمام مالك الواردة في «الموطأ» التي أجراها المالكية مجرى القواعد الفقهية

الملخص
نظرا لمكانة الإمام مالك العلمية، وأهمية كتابه «الموطأ» بين كتب الحديث والفقه، فقد درست في هذا المقال نماذج من نصوص الإمام وأقواله في هذا الكتاب، والتي جاءت في صياغات هي أقرب إلى الضوابط العامة، ثم تطورت فيما بعد وسيرها علماء المذهب مسير القواعد والكليات الفقهية. وألمحت من خلاله إلى نقطة مهمة، وهي أن هذه المرويات عنه قد تشكل النواة الأولى للقواعد الفقهية في المذهب، وأن الإمام مالكا قصد في تأليف «الموطأ» تبيينَ أصول الفقه وفروعه، مما أهَّل كتابه إلى اعتباره أحد المناهل الصافية التي استقى منها المدونون هذه القواعد وأفرزوها في كتبهم. A Selection of Imam Malik’s Texts in “Al-Muwatta” that Maliki Rite Turned into Jurisprudence Rules Abstract: Imam Malik scientific prestige in addition to his book “Al-Muwatta” importance among Hadith and jurisprudence (Fiqh) books prompted us to discuss, through this article, some samples of Imam Malik’s texts and sayings in this book. The ones which are structured so as to be closer to the vital necessities in Islamic religion. These texts have been developed and led by maliki scholars as rules and jurisprudence necessities. The article main aim is to make the evidence that these sayings may represent the nucleus of the jurisprudence rules in the maliki rite; and that Malik himself intended -by writing “Al-Muwatta”- to make jurisprudence sources and branches clearer. This is the very reason to consider it as one of the pure sources for codification that writers took the rules from and mentioned in their books.
