منكرات السوق وأحكامها في تلمسان الزيانية من خلال "تحفة الناظر وغنية الذاكر" لمحمد العقباني التلمساني المتوفّى سنة871هـ/1467م

الملخص
الملخص: يتضمن موضوع هذا المقال دراسة تلك المنكرات و السلوك المذمومة و بعض أحكامها، و على رأسها مناكر الأسواق من غش في البيوع و تطفيف و احتكار وربا و غيرها من المعاصي و التجاوزات اللاأخلاقية، تتأذى منها النفوس ويرفضها الشرع و ينفر منها الطبع، و هو ما جاء به كتاب "تحفة الناظر و غنية الذاكر في حفظ الشعائر و تغيير المناكر" لأبي عبد الله محمد بن أحمد بن قاسم بن سعيد العقباني التلمساني المتوفى سنة871ه/1476م، والذي تضمنه الباب السابع في كشفه و اصداره الأحكام ليس فقط على منكرات الأسواق، و لكن ضد صور أخرى عديدة مثل منكرات الشوارع و المساجد و الطرقات كالغيبة و النميمة و المجادلة و الحلف بغير أسماء الله و صفاته، و خروج المرأة إلى المقابر متزينة بأنواع الزينة وجلوسها إلى الصناع، و الوقوف على حوانيت البياعين، و الفسحة في المنتزهات و البحر. وباعتبار محمد العقباني شاهد عيان لعصره و بيئته، فقد تطرق لهذه القضايا الأخلاقية و الاجتماعية و الآداب العامة، والتي كانت تعبر عن الأوضاع السياسية و الاجتماعية و الاقتصادية التي كانت سائدة في تلمسان الزيانية، وحاول إيجاد الحلول المناسبة لها، وبهذا يكون العقباني قدم نظاما صالحا لكل مجتمع في كل العصور معتمدا على نصوص تم تطبيقها في ظروف تختلف في بعض المجالات عن أوضاع عصرنا هذا. Abstract: This article is the subject of a study that includes those evil and reprehensible behaviors and some of its provisions, mainly markets ANTIPATHIC of fraud in sales and cheating and monopoly and usury and other immoral sins and transgressions, which hurt the souls, rejected by the Islamic law and alienated by human nature, this subject was brought in the book of Abi ABDILLAH Mohammed Bin Ahmed Bin KASSIM Al AKBANI Al TLEMCENI who died in 1476-871, the title of the book "a masterpiece of the beholder and wealth of the reciter in keeping rituals and changing abominations", it was included in the seventh chapter in the detection and issuing of judgments not only on the markets ANTIPATHIC, but against many other sins such as street, mosques and roads abominations like backbiting and gossiping and argue and swearing without the names of Allah and His attributes, also spoke about women heading to CEMETRIES all flaunted, grooming and standing in different shops, hiking in parks and beaches. considering Mohammed Al AKBANI as a witness of his time and his environment, he wrote about the ethical and social issues and the public morals, that reflected the political, social and economic situations, which were prevalent in TLEMCEN ALZAYANIH, and tried to find appropriate solutions for them, and thus Al AKBANI made a valid system for every society during every generation, relying on provisions applied in different circumstances than those of our time.
