الملخص
ملخص يتناول هذا المقال دراسة شروط ممارسة المحكمة الجنائية الدولية لاختصاصها بنظر جريمة العدوان وعوائق ممارسة هدا الاختصاص، في ظل علاقتها بمجلس الأمن الدولي في تقريره لحالة العدوان، وآثار هذه العلاقة على فعالية المحكمة واستقلالها. لهذا بقي اختصاص المحكمة بنظر هده الجريمة معلقا على شروط عديدة. بناء على ذلك سنتطرق لمدى اختصاص المحكمة بنظر العدوان من خلال أهم النتائج المتوصل إليها في المؤتمر الاستعراضي لجمعية الدول الأطراف المنعقد في مدينة كامبالا سنة 2010 Résumé Cet article examine les conditions d’exercice de la compétence de la Cour pénale internationale sur le crime d'agression et les obstacles d'exercice de cette compétence, en particulier sa relation avec le Conseil de sécurité qui signale en l'occurrence l'agression, et les effets de cette relation sur l’efficacité et l’indépendance de la cour. C’est pour cela, la compétence de la Cour reste suspendu à différentes conditions, ce que nous allons chercher est la compétence de la cour sur l’agression par les résultats obtenus à la Conférence d'examen à l'Assemblée des États Partis, dans la ville de Kampala en 2010 Abstract This article examines the conditions the exercise of the jurisdiction of the International Criminal Court on the crime of aggression, and the obstacles that exercise your jurisdiction, specially its relationship with the Security Council. To report the occurrence of aggression and the effects of this relationship on the effectiveness and independence of the court remained jurisdiction of the Court suspended the most important terms. We'll be looking at the jurisdiction, the Court of aggression by the results obtained in the review Conference of the Assembly of States . Parties, in the city of Kampala in 2010.
