الملخص
: يثار في كثير من المرات تساؤل حول جدوى قانون الصّفقات العمومية في ضبط الطلب العمومي بشكل يضمن حقوق أطراف العلاقة بنحو يستجيب لمعطيات السوق الحقيقية، هذا التساؤل يُعبّر عن أحادية تستبعد الممارسات التي يفرزها السوق والتي تأثر على جودة ومصداقية الطلب العمومي والتي لا يمكن رصدها إلاّ بإقران العلاقة بين قانون الصّفقات العمومية وقانون المنافسة. Summary: raised the question many times about the feasibility of public contracts law in controlling public demand guarantees the rights of the parties to the relationship about respond to real market data, this question reflects the single exclude practices which emerge from the market, which affected the quality and credibility of public demand which cannot be monitored only associates the relationship between the public transactions Law and competition law.
