مدى مساهمة أدوات التهيئة والتعمير في حماية النظام العام الجمالي في الجزائر

الملخص
يعتبر حقّ الملكيّة حقّا مقدّسا، يخوّل لصاحبه حقوق الإستعمال والإستغلال والتّصرف في ملكه، ولكن هذا لا يمنع من وجود بعض القواعد والأحكام التي يجب على مالك الرّقبة الإحتكام إليها، ليست لأجل تقييد حرّيته، وإنّما لغرض التّنظيم وحماية العمران وجماله ورونقه، ومن بين هذه القواعد أدوات التّهيئة والتّعمير التي تتمثّل في مجموعة من الرّخص والشّهادات الإدارية، هي في طبيعتها قرارات إدارية، حيث تتمثّل الرّخص في رخصة البناء، الهدم، والتّجزئة، أمّا الشّهادات فتنحصر في شهادة التّعمير، القسمة، والمطابقة، هذه الآليات الرّقابية تلعب دورا هامّا وبارزا في حماية النّظام العام الجمالي للمدينة في الجزائر، وهذا ما يظهر في إجراءات إستصدارها المنصوص عليها قانونا، والتي تشترط على طالبها ضرورة إخضاع طلبه إلى دراسات تقنيّة وقانونيّة، تقوم بها جهات مختصّة، همّها الأوّل والأخير هو المحافظة على الرّونق الجمالي للمدينة، ولكن هذا الدّور لا يصل إلى الحدّ المأمول منه، وذلك بسبب نقص الوعي لدى المواطنين وعدم كفاءة السّلطات المختصّة، وضعف رقابتها الممارسة على هذه التّصرفات العمرانية. كلّ هذا سيتمّ الإستناد عليه في إبراز دور رخص البناء والتّجزئة والهدم من جهة، وشهادات التّعمير والقسمة والمطابقة من جهة أخرى في المحافظة على النّظام العام الجمالي في الجزائر. Abstract: The right to property is a sacred right, which entitles its owner to the rights to use, exploit and dispose of his property, but this does not preclude the existence of certain rules and provisions that the owner of the neck must adhere to, not for the purpose of restricting his freedom but for the purpose of organizing and protecting urbanism, beauty and splendor. The design and reconstruction of a set of administrative licenses and certificates are by nature administrative decisions. Licenses consist of a building permit, demolition and retailing. Certificates are limited to the certificate of reconstruction, division, and conformity. These supervisory means play an important and prominent role in the protection of the system of the aesthetic year of the Algerian cities, and this is what appears in the procedures of issuing it stipulated by law, which requires the applicant to submit his request to technical studies and legal, carried out by competent bodies, the sole concern is to maintain the aesthetic splendor of the city, but this role does not reach the hoped Due to the lack of awareness among the citizens and the inefficiency of the competent authorities, and the weak supervision of the practice on these urban actions. All this will be based on highlighting the role of construction, retail and demolition permits on the one hand, and certificates of reconstruction, division and matching on the other hand in maintaining the aesthetic public order in Algeria.
