اتفاقية حقوق الطفل بين عالمية الحقوق وخصوصية الشعوب

الملخص
الملخص: لقد تناول القانون الدولي حقوق الطفل في عدة اتفاقيات عالمية سواء كانت دولية أو إقليمية و من أهم هذه الاتفاقيات اتفاقية حقوق الطفل التي أرست فيها مبدأ عالمية حقوق الطفل على المستوى الدولي، مما جعل التشريعات الوطنية تتأثر بما أتت هذه الاتفاقية واعتبارها المرجعية القانونية لهذه التشريعات، لكن وجود تشريعات دينية تحكم هذه الشعوب يخلق بعض التصادم والتناقض في النظام القانوني الوضعي في تشريعات الوطنية ذات مرجعيات الدينية مثل الدول الإسلامية مما يعمل على تحفظ بعض الدول على بعض المبادئ والبنود المنصوص عليها في مثل هذه الاتفاقيات مما يطرح إشكالية تناقض محتوى اتفاقية مع الخصوصية الدينية للشعوب ومع حماية حق الطفل في الحفاظ على هويته ومما يؤثر على الحماية الفعلية للطفل في الواقع. Summary: The Convention on the Rights of the Child, which established the principle of universality of the rights of the child at the international level, has made several national legislations influenced by the Convention as a legal reference to such legislation, However, the existence of religious legislation that governs these peoples creates some clash and contradiction in the positive legal system in the national legislations with religious references such as the Islamic countries, which preserves some countries on some of the principles and provisions stipulated in such agreements, which raises the problem of contradiction Contains an agreement with the religious privacy of peoples and with the protection of the right of the child to preserve his or her identity and affect the actual protection of the child in practice.
