الملخص
ملخص الوضع تحت المراقبة الإلكترونية حمل سوار إلكتروني يسمح بمعرفة تواجده في مكان تحديد الإقامة المبين في مقرر الوضع الصادر عن قاضي تطبيق العقوبات ، و يمكن لقاضي تطبيق العقوبات تلقائيا أو بناء على طلب المحكوم عليه شخصيا أو عن طريق محاميه أن يقرر تنفيذ العقوبة تحت نظام المراقبة الالكترونية في حالة الإدانة بعقوبة سالبة للحرية قصيرة المدة. وقد تبنت الجزائر بالوضع تحت المراقبة الإلكترونية بموجب القانون رقم 18/01 المؤرخ في 30 يناير سنة 2018، وبذلك تعتبر أول بلد عربي وثاني بلد إفريقي بعد جنوب إفريقيا، يشرع في العمل بنظام الوضع تحت المراقبة الإلكترونية كإجراء بديل للعقوبة السالبة للحرية قصيرة المدة ، عن طريق جعل المحكوم عليه يقضي فترة عقوبته أو ما تبقى منها خارج أسوار المؤسسات العقابية ، أي بمحل إقامته ، أسوة ببعض الدول الأمريكية والأوروبية المتقدمة التي تعمل به منذ نهاية القرن العشرين. ا. Abstract The Electronic monitoring, also known as SEC or Supervised Electronic Confinement, is not a principal sentence but a way of serving sentence, and it is an alternative to serving time in jail by allowing individuals to live at home but permitting the offenders to venture out of the residence to authorized locations and at certain pre-approved times while being monitored via an electronic ankle bracelet that tracks the offenders movements and location. The Electronic monitoring was adopted by Law No18/01 of January 30, 2018, compels Algeria to be the first Arab country and the second African country after South Africa, like the developed American and European countries that have been operating since the end of the twentieth century. The system of electronic monitoring is introduced as an alternative to short-term deprivation of liberty by making the convicted person serving his sentence or what is left of it outside the walls of the penal institutions, in his place of residence.
