خصوصية الركن المادي لجرائم تسيير الشركات التجارية في التشريع الجزائري

الملخص
الملخَّـص: تتعلق هذه الدراسة بالركن المادي لجرائم تسيير الشركات التجارية في التشريع الجزائري، إذ تبنى المشرع تصورا خاصا للركن المادي لجرائم التسيير متجاوزا بذلك أحكام النظرية العامة للركن المادي للجرائم، بقلبه الاستثناء قاعدة. ففي جرائم التسيير يعتبر السلوك السلبي (فعل الامتناع) المكون للركن المادي فيها هو القاعدة، في حين الاستثناء هو السلوك الإيجابي (القيام بعمل) على عكس ما هو معروف في القواعد العامة. كما أن جرائم الخطر التي تعد الاستثناء حسب القواعد العامة، أصبحت القاعدة العامة في جرائم التسيير، في حين أن الجرائم ذات النتيجة (الضرر) أصبحت الاستثناء. Résumé : Cette étude porte sur l’élément matériel des infractions de gestion des sociétés dans la législation algérienne. En dépassant la théorie générale de l’élément matériel de l’infraction, le législateur algérien a adopté une conception très spécifique de l’élément matériel de l’infraction de gestion. En effet, contrairement aux règles générales ,dans les infractions de gestion, le comportement négatif (non action) constituant l’élément matériel représente la règle et l’exception est le comportement positif.De plus, dans la législation pénale algérienne des sociétés, on peut trouver des infractions de risque comme des infractions de dommage. En revanche le législateur a adopté une politique de pénalisation dont les infractions de risque -l’exception dans la théorie générale- deviennent la règle et les infractions de dommage deviennent l’exception. Abstract : This study related to the physical element of the crimes of the commercial companies, where the Algerian legislature adopted a special vision of the physical corner crimes steering surpassing the provisions of the general theory, his heart exclusionary rule. In steering crimes negative behavior is the norm, while the exception is the positive behavior other than general rules. The danger of crimes are considered by the general rules of the exception, it has become the general rule in the management of crimes, while the crimes of the damage has become the exception.
