جريمة القذف بين الشريعة الإسلامية والقانون الجزائري

الملخص
الملخَّـص: تعد جريمة القذف من الجرائم التي تنال من شرف واعتبار الإنسان. وقد أولت الشريعة الإسلامية لشرف الإنسان أجل الاهتمام والتقدير ويتجلى ذلك من خلال اعتبارها ما يوجه من طعن إلى شرف الإنسان من جرائم الحدود، وقد شرع الله عز وجل حد القذف لكل من تقوده نفسه الأمّارة بالسوء،والذين يحبون أن َتشيعَ الفاحشة في الذين آمنو أو قذفهم والتشفي منهم. كما ساير المشرع الجنائي الجزائري الشريعة الإسلامية في تجريم المساس بشرف الإنسان بتجريمه فعل القذف والاهتمام بكرامة الإنسان وعرضه. Résumé: Diffamations c'est un crime des crimes, qui affectent l'honneur et la considération pour l'humaine. la sharia islamique elle a donné un l'intérêt pour honneur de l'humain. Cela ce qui considéré par l'appel à l'honneur humain mener vers des crimes dans les limites des dispositions de la charia islamique, Dieu Tout-Puissant a procédé assez conduit à la fois, par eux-mêmes est inclinée vers le mal, Pour portent atteinte à l'honneur des personnes ou de les accusations et de vengeance ceux qui aiment que la turpitude se propager parmi les croyants, et ceux qui lancent des accusations contre pour porter atteinte à l'honneur et la diffamation, ou de et ceux qui lancent des accusations contre eux, les Législateur algérien pénal correspond également à la loi islamique de la charia dans la criminalisation de compromettre l'honneur de l'acte humain et criminaliser la diffamation et l'attention à la diffamation et dignité humaine. It considered that the appeal to human honor lead to crimes within the provisions of the Islamic Shariah, God Almighty has made enough leads both by themselves is inclined towards evil, To violate the honor of persons or the accusations and revenge those who like that immorality spread among the believers, and those who launch a charge against to undermine the honor and defamation, or and those who launch a charge against them, the Algerian penal legislator also corresponds to the Islamic Sharia law in criminalizing compromise the honor of the human act and criminalize libel and defamation and attention to human dignity.
