سند المعاملة التجارية كبديل للفاتورة في التشريع الجزائري

الملخص
ملخص: حرص المشرع الوطني على تكريس مبدأ الشفافية في الممارسات التجارية، والتي من خلالها وفر حماية للأعوان الاقتصاديين والمستهلكين على حد سواء، من المنافسة غير المشروعة، والمعاملة التمييزية والمخالفة لشروط البيع، ولتحقيق ذلك نص في القوانين ذات الصلة، ولا سيما القانون رقم (04/02) المؤرخ في 23/06/2004 المحدد للقواعد المطبقة على الممارسات التجارية المعدل والمتمم، على واجب الإعلام بالأسعار والتعريفات وشروط البيع. كما نص على إلزامية الفوترة، كآلية لرقابة الأسعار والحد من المضاربة، وبموجب القانون رقم (10/06) المؤرخ في 15 /08/ 2010، عدل المشرع قانون الممارسات التجارية (السالف الذكر ولا سيما المادة العاشرة منه، والتي نصت على وثيقة تقوم مقام الفاتورة، والتي تم تنظيمها بصدور المرسوم التنفيذي (16/66)، أين سماها في صلب النص "بسند المعاملة التجارية" وخص بها فئة معينة من الأعوان الاقتصاديين، الأمر الذي يستدعي دراستها وتحليل نصوص المرسوم السالف الذكر، خاصة مع تأخر تطبيقها وعزوف الأعوان عن العمل بها. Abstract: The keenness of the national legislature on devoting the principle of transparency in business practices, through which provided the protection of economists and consumers agents alike, against the illegal competition, and preferential treatment, which violates of the conditions of sale, and to achieve this text in the relevant laws, particularly Law No. (04 / 02) dated 23/06/2004 specific rules applied on the business practices, the amending, and also stipulates mandatory billing as a mechanism. The complementary for the duty of the media with prices, tariffs and conditions of sale, to control prices and curbing speculation, under Law No. (10/06) dated 15 August 2010, the Justice legislator amended the trade practices Act (the aforementioned particularly its Article 10, and which provides the document serves as a bill, which is organized by the issuance of the Executive Decree (16/66), where he called at the heart of the text " commercial transaction document" singled out a certain class of economists agents. The thing that calls for study and analysis of the provisions of the decree aforesaid, especially with the delay in implementation and the reluctance of the agents to work with it .
