الملخص
إلى جانب القاعدة النظرية المقررة فقها وقانونا، المتمثلة في استقلالية الذمم المالية للزوجين. هناك قاعدة أخرى فرضها الواقع الذي تعيشه الأسرة الجزائرية تتمثل في قاعدة تداخل أموال الزوجين. فهو اشتراك فعلي، لكنه ليس كالاشتراك المعروف في الأنظمة الغربية، بسبب عدم وجدود أحكام خاصة به. يتدخل القانون في الكثير من الأحيان لتنظيم هذا الاشتراك طبقا الأحكام العامة في مختلف فروعه. كما نجد قانون الأسرة قد فسح المجال أمام الزوجين للاتفاق طبقا للمادة 19 منه، للتنظيم شؤونهما المالية، بحيث نص على أمكانية اتفاقهما بعقد الزواج أو بعقد رسمي لاحق حول مصير الأموال المكتسبة خلال الحياة الزوجية وتحديد النسبة التي تؤول إلى كل واحد منهما. أو طبقا للأحكام العامة للعقد في القانون المدني بالنسبة للاتفاقات الأخرى التي تتم أثناء قيام العلاقة الزوجية.
