حماية الأملاك الوطنية في ظل التحديات الاقتصادية والاجتماعية الراهنة

الملخص
ملخص ارتكزت العديد من الدول على الملكية لرسم سياساتها العقارية والاقتصادية والاجتماعية، وذهب البعض منها الى اتخاذها بوصلة لتحديد توجهاتها الفكرية والايديولوجية، فظهرت الافكار الرأسمالية التي تقدس الملكية الفردية.ثم الافكار الاشتراكية التي دعت الى اعتبار الملكية الجماعية لوسائل الانتاج اساس توجهاتها. كما ان التشريع الاسلامي، الذي جاء للعالمين بنظرة متوازنة وشاملة، أكد على حق الملكية الفردية وجعلها محترمة في اطار الكسب الحلال، واعترف بالملكية العامة باعتبارها ملك الجماعة والدولة مؤكدا على حمايتها. وعليه فان الملكية سواء كانت فردية او جماعية، تحظى بالاحترام في الشرائع السماوية وفي القوانين الوضعية. فبالنظر للأهمية والدور الفعال للملكية في مختلف مجالات الحياة، فهي من جانب اخر محل جدل ونزاع في الكثير من الاحيان بين الافراد فيما بينهم من جهة، او بين الدولة والافراد من جهة ثانية. اما الجانب المتعلق بالاملاك الوطنية، فانها عرفت تطورا كبيرا في مفهومها الحديث خاصة بعد تدخل الدولة وجعلها من ضمن اهتماماتها وسياساتها الكبرى من اجل النهوض بالتنمية الاقتصادية وتشجيع الاستثمارات الوطنية والاجنبية وتحقيق النمو الاجتماعي. فحرصت على ضمان إدارتها وتسييرها، وأخضعتها لإجراءات وأدوات تقنية وحددت لها الآليات القانونية التي تهدف الى المحافظة عليها وحمايتها، من خلال التركيز على الجرد المستمر وفرض الرقابة والتكفل بالنزاعات المتعلقة بها.
