المسائل الأصولية والفقهية في حديث النعمان بن بشير رضي الله عنه "الحَلالُ بيِّنٌ والحَرامُ بيِّنٌ"

الملخص
أوردنا صيغ الحديث والحكم عليه ودراسة الحلقة الأولى والثانية للسند، وأثبتنا أن هذا الحديث من جوامع كلمه صلى الله عليه وسلم، ثم تكلمنا عن القواعد الأصولية في الحديث التي وردت في رواية عبد الله بن مسعود -رضي الله عنه-، وأتبعنا ذلك بالقواعد الفقهية العامة ثم القواعد الفقهية الخاصة بالحلال والحرام، وتوسعنا قليلاً في مسألة هل الأصل في الأشياء الإباحة أم التحريم ورجّحنا بالدليل، ثم موضوع الشبهات وأقسامها ومحاولة فهم نفسية المجتمع وإيجاد حلول لها، ثم الأحكام الفقهية المستخلصة من الحديث، وبحثنا في مسألة الحِمَى الواردة في الحديث، وخصّصنا مسألة مستقلة عن القلب والفؤاد والفرق بينهما أو أوجه الاتفاق والافتراق، ثم الختام بمطلب الجوانب البلاغية ففيه الكثير لأنه من جوامع الكلم وعدَّه العلماء ثالث ثلاثة وبعضهم رابع أربعة. We included the formats of The Prophetic formats and the rule applied on it and the study of the support’s first and the second circle, and we proved that this prophetic tradition is of the prophet’s concise speech -Allah’s peace be upon him- then we talked about the rules of fundamentalism in the tradition received in the narration of Abdullah Ben Mussaood-may Allah be pleased with him-, and we have followed it by the jurisprudence’s general maxims and then the jurisprudence’s maxims specific to lawful and unlawful rules, and we expanded slightly in the question of whether the origin of things is permission or prohibition of and we preferred the evidence. Then the topic of the suspicions and their divisions and trying to comprehend the psychology of society and to find solutions to them, after the jurisprudence’s judgments extracted from the Tradition, and we discussed the issue of the mentioned fever in the Tradition, and we have specified an independent question of the heart, and soul either the difference between both them, or their aspects of the agreement and separation, so that the conclusion about the requirement of lot of rhetorical sides for of the conciseness of speech which is regarded by the scientists the third of three and some the fourth of four.
