اختصاصات المجلس الدستوري الاستشارية

الملخص
This article aims to study and analyse an aspect of the Constitutional Council’s powers that are mentioned scatteredly in the Algerian Constitution. It has become clear that the Constitutional Council was the first to officially give it this name and limited some of its cases through the specific regulations of its successive work rules under the title: Consulting the Constitutional Council in Special Cases. It also became clear that the Constitutional Council neglected to address some of those powers explicitly mentioned in the constitution, and in return, it worked hard to add some powers outside the constitutional text. This article is also considered a basic starting point for another article about the advisory powers of the Constitutional Court in accordance with the 2020 Constitution. يهدف هذا المقال إلى دراسة وتحليل جانب من اختصاصات المجلس الدستوري وردت متناثرة في الدستور الجزائري. لقد تبين أن المجلس الدستوري هو أول من أطلق عليها رسميا هذه التسمية وحصر بعض حالاتها من خلال الأنظمة المحددة لقواعد عمله المتعاقبة تحت عنوان: استشارة المجلس الدستوري في الحالات الخاصة. كما تبين أن المجلس الدستوري أهمل التطرق إلى بعض تلك الاختصاصات المذكورة صراحة في الدستور، وفي مقابل ذلك اجتهد بإضافة بعض الاختصاصات خارج النص الدستوري. كما يعتبر هذا المقال منطلقا أساسيا لمقال آخر حول المحكمة الدستورية طبقا لدستور 2020، ومدى اتباعها لنفس منهجية المجلس الدستوري في تسمية وحصر ما يطلق عليه الاختصاصات الاستشارية.
