الاستشراف ودوره في الحُكم على النّوازل الفقهيّة المُعاصرة، دراسة في ضوء المقاصد الشرعيّة

الملخص
إنّ الاستشراف الفقهيّ والنَّظر في المآلات أمرٌ تنبني علیه كثیرٌ من الأحكام لدى المجتهد لا سیّما ما كان منها متعلّقاً بالنَّوازل والمستجدّات، وإغفال هذا الرُّكن الرّكِين في النَّظر النّوازليّ يوقِعُ في مزالق خطيرةٍ تؤدّي إلى خطأٍ في الفهم وتنزيل الأحكام بعيدًا عن مقاصدها الّتي شُرعت من أجلها ابتداءً، فيأتي هذا البحث لبيان أهميّة النّظر الاستشرافيّ المستقبليّ ودورِه في إصدار الأحكام على مستجدّات العصر. ولخدمة الغرض المنشود؛ انتظم البحث في تمهيدٍ ومبحثان: المبحث الأوّل بُسِط فيه القول في مفهوم اعتبار المآل وتأصيله، والمبحث الثّاني تناول أهميّة اعتبار المآل ورُكنيّته في دراسة النّوازل المعاصرة. Judicial oversight and consideration of procrastinations is a matter upon which many of the judgments of the diligent are based, especially those related to diversions and developments. Neglecting this pillar of the Nazi viewpoint leads to serious pitfalls that lead to misunderstanding and stealing judgments away from their intended purposes. This research comes to demonstrate the importance of forward-looking thinking in the future and its role in judging the latest developments of the age. To serve the intended purpose; The research was organized into two introductions and two papers: the first elaborated on the concept of the consideration of the prognosis and its origin, and the second examined the importance of the consideration of the prognosis and its basis in the study of contemporary descendants.
