الحصانات المستترة في النظام الأساسي للمحكمة الجنائية الدولية الدائمة Immunities Hidden In The Statute Of The Permanent International Criminal Court

الملخص
يُعتبر مبدأ عدم الاعتداد بالحصانات من أهم المبادئ التي قام عليها نظام روما الأساسي المنشأ للمحكمة الجنائية الدولية الدائمة من أجل تحقيق الهدف الأسمى الذي وجدت من أجله، ألا وهو القضاء على ظاهرة الإفلات من العقاب، ولكن احتواء نظام روما على بعض النصوص والثغرات القانونية التي تم فرضها من طرف الدول العظمى التي كانت تسعى لإفشال مشروع إنشاء المحكمة، أدى إلى إفراغ ذلك المبدأ من محتواه، بحيث شكلت تلك النصوص عراقيل قانونية في مواجهة المحكمة لدى ممارستها اختصاصها في متابعة مرتكبي الجرائم المنصوص عليها في نظامها الأساسي، وهو ما يمكن اعتباره بمثابة حصانات مستترة تم منحها بموجب تلك النصوص لهؤلاء المجرمين. The principle of non-consideration of immunities is one of the most important principles on which the Rome Statute of the Permanent International Criminal Court was founded in order to achieve the ultimate goal for which it existed, which is to eliminate the phenomenon of impunity, but the Rome Statute contains some texts and legal loopholes that were imposed by the great powers that were seeking to thwart the project to establish the Court, led to emptying that principle of its content. so that these texts constituted legal obstacles in the face of the Court. In exercising its competence to prosecute the perpetrators of the crimes set forth in its Statute, which can be considered as hidden immunities granted under those provisions to these criminals.
