تجديد مقاصد الشريعة عند الشيخ الطاهر ابن عاشور

الملخص
إنّ الشيخ محمد الطاهر ابن عاشور من أشهر اعلام الزيتونة وأبرز شيوخها في القرن العشرين، وقد كان له فضل تطوير فقه مقاصد الشريعة الإسلامية ، إذ ساهم في تجديد فقه اصول الدين عبر اضافة مقصد الحرية ومقصد المساواة وحفظ مصالح الامة. لقد نادى الشيخ ابن عاشور بضرورة تنزيل أصول الفقه تنزيلا عقليا ، بما يجعل دراسة المقاصد ضرورة لصدّ القراءة الحرفية الظاهرية للنصوص .فالشيخ محمد الطاهر ابن عاشور يتطلع لرؤية المسلمين وهم يجتهدون بقوة من أجل الجماعة ، فقد تأكد لديه أن غياب الاجتهاد قد عاد بالوبال على الأمة ، لذا فإنه بادر بمراجعة مناهج القدامى من مؤسسي فقه المقاصد. Sheikh Muhammad Al-Tahir ibn Achour is the most renowned Zaytuna Imam and one of the great Islamis scholars of the 20th century. Sheikh Ibn Achour developed the teory of Maqasid Al Shari’a ; the methodologie for the renewal of the theory of Islamic law , he added freedom ,equality,and rights of nation,He claimed that the basis of chari'ah must be rational. Therefore, the maqassid of the chari'a must be engaged ,and he called against the literal occasions that the Zahiri hold. Sheikh Ibn Achour wanted to see Muslims coming forth to practice ijtihad for the global community. It was clear to him that the lack of ijtihad had grave consequences so he review all the methods of the classics book’s in Maqassid Al chari’a.
