الحماية القانونية للمعارف التقليدية ودورها في تحقيق التنمية المستدامة في الدول النامية

الملخص
أحدث التقدّم التكنولوجي تطوّرا كبيرا في أنظمة الملكية الفكرية التقليدية، مما أفرز أنظمة حديثة اقتحمت هذا المجال بدأ الاهتمام بها، وبتوفير حماية قانونية لها؛ من ذلك مثلاً المؤشرات الجغرافية، وحماية الأسماء على مواقع شبكة الانترنت، وحماية التجارة الالكترونية، وحماية المواد الوراثية والمعارف التقليدية والفولكلور؛ هذه الأخيرة التي أصبحت لها قيمة اقتصادية وثقافية هامّة. حيث أصبحت تمثّل قضية حيوية لغالبية الدول النامية وشعوبها، لكونها المالك الأساسي لكافة معارفها التقليدية، وينبغي أن تكون المتصرّف الوحيد في تلك المعارف بما يحفظ لها حقوقها من الاستغلال غير المشروع، وأعمال القرصنة التي تتعرّض لها بصورة مستمرة ومتزايدة؛ ولهذا فرعاية هذه المعارف التقليدية وتقرير الحماية القانونية لها، له بالغ الأثر في تحقيق التنمية المستدامة في تلك الدول. Technological progress has brought about a significant development in traditional intellectual property systems, which has produced modern systems that have entered this field, and attention has begun to be paid to them and to provide them with legal protection. For example, geographical indications, protection of names on websites, protection of electronic commerce, protection of genetic materials, traditional knowledge and folklore; The latter has become of important economic and cultural value. It has become a vital issue for the majority of developing countries and their people, as they are the primary owners of all their traditional knowledge. Therefore, caring for this traditional knowledge and establishing legal protection for it has a profound impact on achieving sustainable development in those countries
