المحاكم التجارية المتخصصة خطوة نحو القضاء المتخصص في التشريع الجزائري

الملخص
مـلخـص: تعد المحاكم التجارية المتخصصة، اختصاص نوعي مستحدث تعزز به القضاء الجزائري، بموجب القانون رقم 22-13 المعدل والمتمم لقانون الإجراءات المدنية والإدارية رقم 08-09، وهذا تماشيا مع واقع التجارة في الجزائر ، حيث نجد أن المشرع الجزائري حدد طبيعة القضايا التي يؤول الفصل فيها للمحكمة التجارية المتخصصة على سبيل الحصر، بتشكيلة جماعية تتكون من قاضي متخصص في المجال التجاري رئيسا وأربعة مساعدين ممن لهم دراية واسعة بالمسائل التجارية، ويكون لهم رأي تداولي وليس إستشاري، ولأن المنازعات التجارية التي تختص بها المحكمة التجارية المتخصصة تكون معقدة وتقنية و دولية في كثير من الأحيان، تم تكريس إجراء الصلح كقيد على رفع الدعوى، باعتباره من الطرق البديلة لحل تلك النزاعات، يهدف لتخفيف عبء اجراءات التقاضي على المتقاضين، فالصلح يتم إجراؤه من قبل أحد القضاة التابعين للمحكمة التجارية المتخصصة و يسمح بحسم الخصومة قبل مباشرة إجراءات المخاصمة القضائية. الكلمات المفتاحية: المحاكم التجارية المتخصصة؛ تشكيلة المحكمة؛ الصلح؛ الإختصاص النوعي؛ التنظيم القضائي Abstract: Specialized commercial courts are a qualitative new jurisdiction that strengthens the Algerian judiciary, under Law No. 22-13 amending and supplementing the Civil and Administrative Procedures Law No. 08-09, in line with the reality of trade in Algeria.We find that the Algerian legislator specified the nature of the cases to be decided by the Specialized Commercial Court exclusively A group consisting of a commercial judge as president and four assistants with extensive knowledge of commercial matters. They shall have a deliberative rather than an advisory opinion, and because commercial disputes under the jurisdiction of the Specialized Commercial Court are often complex, technical and international, The reconciliation procedure was enshrined as a restriction on the filing of a lawsuit, as an alternative way to resolve those disputes, It aims to ease the burden of litigation proceedings on litigants, as the conciliation is conducted by one of the judges of the Specialized Commercial Court and allows the resolution of litigation before the commencement of litigation proceedings.
