الملخص

ملخص: تهدف هذه الدّراسة المعنون لها بـ: "حكم نسبة الأصول المخرّجة للأئمّة –دراسة أصوليّة تطبيقيّة-" إلى بيان مفهوم تخريج الأصول من الفروع, ومدى اعتماد علماء المذاهب عليه في نسبة الأصول غير المصرّح بها للأئمّة أبي حنيفة ومالك والشّافعي وأحمد –رحمهم الله تعالى- وذلك من خلال تقديم نماذج تطبيقيّة. وقد توصّل البحث إلى جملة من النّتائج لعلّ من أهمّها: أنّ منهج تخريج الأصول من الفروع مارسه جميع أصحاب الأئمّة وأتباع المذاهب الفقهيّة ولم يقتصر على مذهب دون آخر؛ لذلك يصحّ نسبة الأصول المخرّجة من الفروع المأثورة عن الأئمّة إذا استوفى التّخريج شروطا معيّنة, وهي: أن يكون مبنيّا على الاستقراء التّامّ أو الواسع النّطاق, وأن يكون المخرّج أهلا للتّخريج, وأن تقيّد هذه النّسبة بلفظ يشعر أنّ الأئمّة لم ينصّوا على هذه الأصول ولم يصرّحوا بها. Abstract : This study aims at shedding lights on the concept of extracting the fundamentals from the subordinates in the field of jurisprudence principles and to what extent the four Imams of the Islamic schools-Abi Haniffa, Malik, Al- Shafai and Ahmed- may God have mercy on them- relied on to find out the affiliation of unknown fundamentals. This was realised through using concrete and applied models. The findings are many. The first and the foremost one tends to be that the approach of extracting the fundamentals from the subordinates is practiced by all the Imams of the four Islamic schools and their followers too. So it is true to relate the affiliation of the extracted fundamentals from the subordinates to the four Islamic schools if they fulfil special conditions. Firstly, to be based on complete and extensive induction. Secondly, the extractor should be eligible for the process. Thirdly, the extractor have to relate his/her extraction with expression to convey that the fundamentals are not mentioned by the four Imams of the Islamic schools.
