الملخص
ملخص: تناولنا في هذا البحث التزامات المستثمر الأجنبي تجاه الدولة المضيفة ، وتم التركيز على المملكة العربية السعودية باعتبارها الدولة المضيفة، وتناولنا مفهوم وأهمية الاستثمار الأجنبي وأنواعه سواء المباشر، وغير المباشر، ومدى تقيد المستثمر الأجنبي بالقوانين واللوائح المعمول بها في الدولة المضيفة، وتم تقسيم الالتزامات الواجبة على المستثمر الأجنبي إلى التزامات تنظيمية منها إشعار هيئة الاستثمار بالبدء في المشروع وتحديد ووقت الانتهاء منه وتجهيزه للعمل، والالتزام بالجدول الزمني، واتباع نظام محاسبي معتمد، وتقديم تقرير سنوي، والافصاح عن وسلامتها، والحد من التلوث ونقل التكنولوجيا الحديثة. والالتزامات الإجرائية مثل تدريب، وتأهيل العمالة، وعدم التأخر في تنفيذ المشروع، والتزامه أيضأ بالتنمية وخدمة المجتمع، والتزامه بعدم المنافسة، وعدم التدخل في الشؤون الداخلية أو السياسية للدولة. ثم تناولنا الجزاء على مخالفة هذه الالتزامات، ومنها فرض غرامات مالية، وحرمان من بعض أو كل الحوافز، أو سحب الترخيص. In this research, we discuss foreign investor's obligations of Sultanate of Kingdom of Saudi Arabia . This paper focuses the concept of investment, and its types, of investment both directs and indirect and how that is important. The research covers the foreign investor’s regulations, and how they follow the laws and regulation in Sultans of Oman State. This research has explained regulatory obligations, including notifying the Investment Authority when the projects start, determining the time of completion and the processing of the project, following the timetable applying a certified accounting system, submitting an annual report, disclosing any information, documents and any major changes in the project. The research has covered the objective of the investor’s obligations, include preservation of the environment, reducing the pollution and transferring the modern technology. The research also covers the procedural obligations include the training of employments, the lack of delay of the project and how that affects the development of the community. The research covered the investor’s commitment to non-competition and non-interference in the internal or political affairs of the state. We have explained the penalties for breaches of these obligations, including fines and denial of some or all incentives withdrawal of the license..
