الملخص
ملخص البحث: هدفت الدراسة إلى بيان السياسة الشرعية من خلال قاعدة درء المفاسد أولى من جلب المصالح، وذلك إلى بيان تعريف السياسة الشرعية، وعلى ببيان مصادرها ودورها من خلال قاعدة درء المفاسد أولى من جلب المصالح وتطبيقاتها من السنة النبوية، واستخدم في ذلك المنهجين: المنهج الوصفي الاستقرائي والمنهج الوصفي التحليلي، وذلك بتتبع البيانات وجمعها وتحليلها، حول موضوع دور السياسة الشرعية من خلال قاعدة درء المفاسد أولى من جلب المصالح، وخلصت الدراسة إلى مجموعة من النتائج أهمها: للسياسة الشرعية مصادر معتبرة من الشريعة الإسلامية تعطي فوائد عظيمة للمجتمع الإسلامي وأهمية كبيرة بكافة مجالات حياتهم، وأوصت الدراسة إلى إجراء دراسات مشابهة في موضوعات السياسة الشرعية من خلال قواعد الفقه الإسلامي مثل: دور السياسة الشرعية من خلال قاعدة الضرر يزال، أو دور السياسة الشرعية من خلال قاعدة العادة محكمة.
