حماية الصحة العقلية ودور القانون الداخلي في تصنيف المخدرات والمؤثرات العقلية وتجريم الاستعمال والاتجار غير المشروعين بها في ظل القانون رقم 23-05 المعدل للقانون رقم 04-18

الملخص
تُعتبر الظاهرة الإجرامية من الظواهر السلبية التي عانت منها المجتمعات منذ القدم، لمساسها بحرمة الحياة أو المال أو النفس أو العقل، وما عكفت الدول والأنظمة في وضع ضوابط قانونية في إطار الشرعية للحفاظ على النظام العام وضبط سلوك الفرد داخل المجتمع، وباعتبار النظام العام يتشكل من أركان مهمة وهي الأمن العام والصحة العامة والسكينة العامة والآداب، وهي مُكملة لبعضها لتحقيق الأمن والطمأنينة داخل المجتمع، الذي يصبو إليه كل مكونات المجتمع من أشخاص طبيعية أو أشخاص معنوية، وتعتبر الصحة العامة من أهم انشغالات الدول لضمان الحفاظ على صحة المواطنين سواء أكانت صحة عامة أو صحة عقلية أو صحة حيوانية أو حتى نباتية، وأهمية الصحة العقلية لا تخفى على أي كان لأن حفظ العقل من مقاصد الشريعة الإسلامية، ومن أهم أهداف حماية النظام العام، لأن العقل السليم هو الضامن لسلامة التفكير وحسن التدبير، والعامل المهم في تطور المجتمعات البشرية، وهذا ما يجعل من موضوع هذه المداخلة المرتكزة أساسا على حفظ الصحة العقلية ذات أهمية بالغة، من خلال تبيان دور القانون الداخلي في تصنيف المخدرات والمؤثرات العقلية ومكافحة الاتجار والاستعمال غير المشروعين بها، لاسيما في ظل التعديل الأخير بموجب القانون رقم 23-05 المعدل للقانون رقم 04-18. The criminal phenomenon is considered one of the negative phenomena that societies have suffered from since ancient times, because of its harm to a person’s life, his money, his soul, or his mind. States and systems have continued to combat this phenomenon by establishing legal controls to maintain public order and regulate the behavior of the individual within society, and since public order is formed It consists of three important pillars, which are public security, public health, and public tranquility, and they complement each other to achieve security and tranquility within society, which is aimed at by all segments of society, whether natural or legal persons. Public health is considered one of the concerns of states, to ensure the preservation of the health of citizen The importance of mental health is clear to anyone, because preserving the mind is one of the aims of Islamic law, and one of the most important aims of protecting public order, because a healthy mind is the guarantor of sound thinking and good management, and the important factor in the modernity of human societies, and this is what makes the subject of this article The intervention, which is primarily based on preserving mental health, is of great importance, by clarifying the role of internal law in classifying drugs and psychotropic substances and combating their illicit trade and use, especially in light of the recent amendment under Law No. 23-05 amending Law No. 04-18.
