خطورة المناطق الآمنة على حياة المدنيين وضحايا النزاعات المسلحة

الملخص
ملخص: المناطق الآمنة تعد من التدابير الوطنية والدولية في نفس الوقت اذ يمكن انشائها من طرف سلطات الدولة أو أحد طرفي النزاع او بقرار من الأمم المتحدة عن طريق مجلس الأمن بشكل خاص ،وبالتالي كانت الغاية من هذه الدراسة البحث عن أهمية هذه الأماكن في توفير الحماية للمدنيين وضحايا النزاعات المسلحة ،ببحثنا عن تعريف واضح لها من النواحي الفقهية والقانونية والكشف عن النصوص الاتفاقية الدولية لمعرفة مدى قوتها وفاعليتها في تأمين الحماية ومدى التزام أطراف النزاع بها ،حيث خلصنا الى نتيجة صادمة جدا وخطيرة في نفس الوقت إذ تشكل المناطق الآمنة خطر على حياة من لا يشتركون في العمليات العدائية بحيث يمكن إبادتهم بسهولة من خلال تجميعهم في مكان واحد والقضاء عليهم تحت ذريعة أنه تم استغلالها لأغراض عسكرية ومنه جواز مهاجمتها بحجج واهية ودون أي دليل على ذلك وأمام مرئ المجتمع الدولي دون رقيب ولا حسيب. Abstract: Security zones are considered both national and international measures, because they can be established by state authorities, by one of the parties to the conflict, or by a United Nations decision through the Security Council. The purpose of the study was to explore the importance of such zones in the protection of civilians and victims of conflict, seeking a clear legal and jurisprudential definition of such places, and disclosing the texts of international treaties to determine the extent of their force and their effectiveness in ensuring the protection and engagement of the parties to the conflict. We have come up with an alarming and dangerous result, because safe zones pose a danger to the lives of those who do not participate. Hostile operations can easily destroy them by regrouping them in one place, on the pretext that they have been exploited for military purposes, including the possibility of attacking them under false pretenses and without any evidence, under the gaze of the international community, without any control or responsibility.
