المسؤولية العقدية في عقد الاحتراف الرياضي

الملخص
تهدف هذه الورقة البحثية لتسليط الضوء على موضوع في غاية الأهمية، أضحى يشغل مختلف الأوساط والمنابر البحثية. والمتعلق بالأطر القانونية والمؤسساتية لعقود الاحتراف الرياضية، هذه الأخيرة التي تشكل أحد أهم أوجه العقود التي تسير الجانب الرياضي، على اعتبار أن هذا المجال أصبح يعرف حركية اقتصادية تتعلق بحجم الاستثمارات المالية والعوائد المالية الضخمة الناتج عن تحويلات اللاعبين، الأمر الذي استدعى ضرورة أن تكون هناك حركية تشريعية تواكب التأسيس القانوني لهذا العقود وتنظيم أحكامها. نتيجة لهذا كان الغرض من هذه الدراسة التوصل لمعرفة النظام القانوني الذي يحكم وينظم عقود الاحتراف الرياضية، خاصة أن هذه الأخيرة تخضع للنظرية العامة للعقد مع بعض الخصوصيات عند الابرام. إلى جانب التطرق للأطراف المشكلة لهذا العقد، وصولا لمعرفة الحقوق والالتزامات التي يرتبها هذا العقد، والقواعد العامة للمسؤولية المترتب عن الأضرار التي يخلفها هذا العقد Abstract: This research paper aims to shed light on a very important topic, which is occupying various research circles and platforms. And related to the legal and institutional frameworks for professional sports contracts, the latter which constitutes one of the most important aspects of the contracts that run the sports side, given that this field has become known as an economic movement related to the volume of financial investments and the huge financial returns resulting from the transfers of players, which necessitated the need for there to be movement Legislative legislation that accompanies the legal establishment of these contracts and the regulation of their provisions. As a result, the purpose of this study was to find out the legal system that governs and regulates professional sports contracts, especially since the latter is subject to the general theory of the contract with some specifics when concluding. In addition to addressing the parties forming this contract, in order to know the rights and obligations arising from this contract, and the general rules for the liability resulting from the damages left by this contract.
