Criminal Liability Of The Commercial Company For Crimes Of Illegal Speculation

Abstract
Abstract: This study seeks to shed light on the criminal responsibility of the commercial company for crimes of illegal speculation, as the Algerian market has recently witnessed a clear fluctuation in many widely consumed goods and materials, as well as an unjustified rise in their prices, as a result of illegal practices represented by illegal speculation. These behaviors reached their peak during the spread of the Coronavirus Covid19, which prompted the Algerian legislator, like other legislation, to issue Law No. 21-15, related to combating illegal speculation, which came with new substantive and procedural rules. الملخص: تسعى هذه الدراسة إلى تسليط الضوء على المسؤولية الجزائية للشركة التجارية عن جرائم المضاربة غير المشروعة، حيث شهدت السوق الجزائرية في الآونة الأخيرة تذبذبا واضحا في الكثير من السلع والمواد واسعة الاستهلاك وكذلك ارتفاعا غير مبرر في أسعارها، نتيجة ممارسات غير مشروعة تتمثل في المضاربة غير المشروعة، وبلغت هذه السلوكات ذروتها اثناء انتشار فيروس كورونا كوفيد 19، الأمر الذي دفع بالمشرع الجزائري على غرار باقي التشريعات الاخرى إلى إصدار القانون رقم 21-15، المتعلق بمكافحة المضاربة غير المشروعة جاء بقواعد موضوعية وإجرائية جديدة
